UK Funeral Directors Barbados Competition Terms and Conditions – OpusXenta Limited 

  1. The promoter
    The promoter is: OpusXenta Limited, a private limited company registered in England and Wales with company number 12520696 of Regus House, Whitehill Way, Swindon, England, SN5 6QR (“Promoter”)
  2. The competition
    1. The title of the competition is the “UK Funeral Directors’ Barbados Holiday Competition”.
    2. The competition is open to all registered funeral directors in England, Northern Ireland, Wales and Scotland.
  3. How to enter
    1. The competition will run from 00:00 on Thursday 1st December 2022 (the “Opening Date“) to 23:59 on Tuesday 28th February 2023 (the “Closing Date“) inclusive.
    2. All competition entries must be received by the Promoter by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
    3. To enter the competition you must enter online at https://apps.byond.cloud/join registering your professional details by the Closing Date and be approved by OpusXenta management. You will receive an automatic confirmation of registration if approved.
    4. No purchase necessary and there is no charge to register for use of the website.
    5. The Promoter will not accept:
      1. responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of transmission or similar as proof of receipt of entry to the competition.
    6. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
    7. The competition entries will be assessed by a panel of judges and a winner randomly selected. The decision of the panel of judges (acting reasonably) will be final.
  4. Eligibility
    1. The competition is only open to all registered Funeral Directors in England, Northern Ireland, Wales and Scotland aged 18 years or over.
    2. In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition
    3. The Promoter will not accept competition entries that are:
      1. automatically generated by computer;
      2. completed by third parties or in bulk;
      3. illegible, have been altered, reconstructed, forged or tampered with; or
      4. incomplete.
    4. There is a limit of one entry to the competition per Organisation. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    5. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
  5. The prize
    1. The prize is a five (5) night holiday for two adults in a classic double room and includes all flights, accommodation and meals at a five star hotel in Barbados plus GBP500 spending money.
    2. The holiday is for two adults to travel by aeroplane together from a UK airport to Barbados for 5 nights and includes one checked bag per person of up to about 22kg (depending on the carrier) and which must be booked by 15th April 2023 and completed by 31 November 2023.
    3. The prize does not include:
      1. travel insurance (the winner is advised to take out their own insurance),
      2. the cost of transfers to and from airports or stations,
      3. food and drink in transit,
      4. alcoholic beverages unless specifically included in the hotel package,
      5. additional spending money over and above the GBP500 to be included in the prize, tax or personal expenses,
      6. any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.
    4. You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas, health requirements and travel documents for the holiday in question on the travel dates specified. Dates once notified to the travel agent cannot be changed.
    5. Prizes are subject to availability. There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.
    6. The prize is not negotiable or transferable.
  6. Winner
    1. The decision of the Promoter is final, and no correspondence or discussion will be entered into.
    2. The Promoter will contact the winner as soon as practicable after the Announcement Date, using the email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form which is constituted by the registration process has been submitted.
    3. The Promoter will either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of the winner on or abouts the 7th March 2023 on the www.opusxenta.com website.
    4. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at the following email address: bernardf@opusxenta.com. In such circumstances, the Promoter will still provide the information and winning entry to the Advertising Standards Authority on request.
  7. Claiming the prize
    1. If you are the winner of the prize, you will have 7 working days from the Announcement Date to claim the prize by responding to the wining announcement email by emailing the Promoter. If you do not claim the prize by this date, your claim will become invalid. Emails in this respect may be sent to bernardf@opusxenta.com.
    2. The prize may not be claimed by a third party on your behalf.
    3. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or does not respond to the announcement , or has not claimed their prize within 7 working days from the Announcement Date, the Promoter reserves the right to offer the prize to an alternate eligible entrant.
    4. The Promoter does not accept any responsibility if you are not able to take up the prize.
  8. Limitation of Liability
    1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
    2. No liability is accepted for any losses or damage caused by the hotel or airline.
  9. Data protection and publicity
    1. The Promoter will only process your personal information as set out in our Privacy Policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.
  10. General
    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    2. The Promoter reserves the right to hold, void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
